1. Acceptance of These Terms

By creating an account or otherwise using Hatchbit (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be old enough to lawfully use the App under the laws of the country in which you reside, and in any case must be at least 13 years old. By using Hatchbit, you represent that you meet these requirements.

3. Your Account

To use Hatchbit you must create an account, either with an email address and password or by signing in with Apple or Google. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us at hatchbitsupport@gmail.com if you believe your account has been accessed without your permission.

4. User-Generated Content

Hatchbit lets you upload or create certain content, including a profile picture and text you enter yourself, such as your username, display name, and habit names ("User Content"). You retain ownership of your User Content, but by submitting it you grant Hatchbit a non-exclusive, worldwide, royalty-free license to host, store, and display that content as needed to operate and provide the App. You are solely responsible for the User Content you submit, and you agree not to upload or create content that infringes the rights of others or violates applicable law.

Copyright / DMCA Notices

If you believe that content on Hatchbit infringes your copyright, please send a notice of infringement to hatchbitsupport@gmail.com, including a description of the copyrighted work, the material you believe is infringing, and your contact information. We will review and respond to valid notices in accordance with applicable copyright law.

5. Essence and Creatures (Virtual Items)

Hatchbit is entirely free to use. There are no in-app purchases, no subscriptions, and no way to buy goods, items, or currency of any kind. The App's in-game currency ("Essence") and collectible creatures are earned only through use of the App — for example, by maintaining habit streaks — and can never be purchased.

Essence and creatures have no real-world monetary value, cannot be exchanged or redeemed for cash or any other form of compensation, and cannot be transferred outside the App. The only exception is Hatchbit's own in-app trading feature, which allows users to trade creatures directly with one another within the App.

6. Hatchbit's Intellectual Property

The Hatchbit name, logo, branding, and all associated trademarks, along with the App's design, artwork, and software, are the exclusive property of Hatchbit. Nothing in these Terms grants you any right to use Hatchbit's intellectual property except as necessary to use the App as intended.

7. Feedback

If you send us feedback, ideas, or suggestions about Hatchbit, you agree that we may use them for any purpose, including to improve the App, without any obligation to compensate you or attribute the feedback to you.

8. Acceptable Use

When using Hatchbit, you agree not to:

• Harass, threaten, or abuse other users;
• Cheat, exploit bugs, or otherwise manipulate the App in ways not intended by its design;
• Abuse the friends, trading, or leaderboard features, including through fraudulent or manipulative trades or rankings.

Hatchbit provides block and report-user features so you can protect yourself from other users. Hatchbit may suspend or terminate accounts that violate these Terms, at its discretion.

9. Termination

You may stop using Hatchbit at any time. We may suspend or terminate your access to the App, with or without notice, if we believe you have violated these Terms or engaged in conduct that harms Hatchbit or other users.

10. Disclaimer of Warranties

Hatchbit is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, Hatchbit will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if advised of the possibility of such damages.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will make reasonable efforts to notify you, such as by updating the "Last updated" date above. Your continued use of Hatchbit after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to its conflict of law principles.
